Fair Access establishes an equitable balance in Internet access across broadband services by service plan for all HOTSPOTPR.NET customers regardless of their frequency of use or volume of traffic. To ensure this equity, customers may experience some temporary throughput limitations. HOTSPOTPR.NET Internet access is not guaranteed. This policy applies to all service residential plans where customers use of the Service is not limited to a specific number of hours per month.

HOTSPOTPR.NET system usage data indicates that approximately 5% of subscribers are responsible for a disproportionate share often as much as half of the total HOTSPOTPR.NET service traffic. Unfortunately, many of those subscribers are not using HOTSPOTPR.NET for its intended purpose. To ensure that all HOTSPOTPR.NET subscribers have fair and equal access to the benefits of the broadband service, HOTSPOTPR.NET has enacted a Fair Access Policy to prevent abusive consumption of bandwidth by a handful of users.

FAP is straightforward: based on an analysis of usage data, Network Systems has established a HOTSPOTPR.NET usage threshold well above the maximum typical usage rates. When a customer exhibits patterns of system usage which exceed that threshold for an extended period of time, the FAP may temporarily limit that subscriber’s throughput to ensure the integrity of the system for all HOTSPOTPR.NET subscribers.

HOTSPOTPR.NET goal is to give each of our customers the fastest service possible at the lowest possible price. We are always striving to develop programs and policies that help make that possible. Our Fair Access Policy is designed to impact the fewest customers while helping ensure the best speeds for the vast majority of our customers.

HOTSPOTPR.NET estimates that a small percent of customers account for a disproportionate share of data usage on the HOTSPOTPR.NET network. To ensure that all HOTSPOTPR.NET customers have equitable access to the HOTSPOTPR.NET network, HOTSPOTPR.NET has implemented a Fair Access Policy (or FAP). HOTSPOTPR.NET sets usage thresholds on the amount of data you can upload and download within stated time periods. If you exceed these thresholds, HOTSPOTPR.NET will temporarily limit the speed at which you can send and receive data over the HOTSPOTPR.NET access network. You will still be able to use the HOTSPOTPR.NET Internet access service but your speed will be slower. In cases of extreme and continued violation of the FAP limitations, your service may be suspended. HOTSPOTPR.NET may use other traffic management and prioritization tools to help ensure equitable access to the HOTSPOTPR.NET network for all customers. Your HOTSPOTPR.NET Internet access is not guaranteed and is subject to this FAP.

Based on an analysis of typical customers, HOTSPOTPR.NET has set a rolling 30-day limit on data usage per customer, called a Usage Threshold. As shown in the table below, this threshold varies based on the service plan you selected. For each service plan, the Usage Thresholds are significantly above the amount of data that is used by a typical customer. Every day, HOTSPOTPR.NET measures your upload and download data usage (Actual Usage) to determine if your total Actual Usage, as aggregated over the previous 30 days (Usage Total), exceeds the Usage Threshold for the service plan that you selected. At any time, you can see your Usage Total versus your monthly Usage Threshold under the User Control Panel atmyaccount.hotspotpr.net.

HOTSPOTPR.NET will notify you via your HOTSPOTPR.NET contact email address if your Usage Total reaches 80% or more of the Usage Threshold. If at any time your Usage Total is above the Usage Threshold, HOTSPOTPR.NET will reduce your HOTSPOTPR.NET access speeds, typically to 128 kbps in the downstream (from the Internet to you) and 128 kbps in the upstream (from you to the Internet) until your Usage Total is 80% or less than the Usage Threshold. Once your Usage Total reaches this level, your access speeds will be restored to the original speed levels by the next bill.

You are likely to avoid any limitations imposed by the FAP if your use is typical of the majority of Internet users and consists primarily of Web surfing and a reasonable amount of downloading. The table below shows the monthly Usage Thresholds for each plan. These limits specify the amount of data that you can upload and download before your access speed is reduced. Please note that your Usage Total is far more likely to exceed the Usage Thresholds below if you use peer-to-peer file sharing programs, you use a webcam or you download full length movies, large quantities of music files, full software applications or similar high-bandwidth activities.

Legacy Fair Access Policy Plans

HOTSPOTPR.NET FAP Legacy Monthly Usage Thresholds Residential Service Plans

Plan

256Kbps

512Kbps

1Mbps

3Mbps

5Mbps

Download Threshold (A)

15 GB

25 GB

50 GB

100 GB

200 GB

Upload Threshold (B)

5 GB

10 GB

15 GB

20 GB

30 GB

(A) Download Threshold is the volume of data that can be downloaded during the previous 30 days before the
Fair Access Policy may restrict the user’s speeds.

(B) Upload Threshold is the volume of data that can be uploaded during the previous 30 days before the

HOTSPOTPR.NET FAP Monthly Total Thresholds Residential Service Plans

Plan

1Mbps

3Mbps

5Mbps

8Mbps

Total Threshold

75 GB

150 GB

200 GB

300 GB

New Fair Access Policy Plans

HOTSPOTPR.NET FAP Monthly Total Thresholds Residential Service Plans

Plan

1Mbps

3Mbps

5Mbps

10Mbps

Total Threshold

75 GB

150 GB

175 GB

300 GB

Fair Access Policy may restrict the user’s speeds.

These terms and conditions state important requirements regarding your use of HOTSPOTPR.NET Speed Internet service and your relationship with HOTSPOTPR.NET.
